
The new public guarantee against non-payment launches full of limitations: at Inmopolt we explain why it is not a real solution for property owners.
The Government has announced a new royal decree intended to offer property owners coverage against possible non-payment in rental contracts aimed at young people and vulnerable individuals. On paper, it may seem like good news. But when analyzed in detail, its limitations mean that this measure falls far short of providing the protection that a property owner truly needs.

A public guarantee with such restrictive requirements that it will barely reach anyone.
For a property owner to be eligible for the new guarantee, they must meet requirements as strict as the following:
- Rent exclusively to people under 35 or to individuals considered vulnerable by each autonomous community.
- Set a rent equal to or below the state reference index, a figure well below the real market value.
- Have deposited the security deposit and all its updates.
- Sign a specific document with the tenant using an official template that has yet to be developed.
In addition, the coverage will only apply to contracts in force as of January 30, 2025, leaving out the vast majority of new leases.
What is intended to be a security system for landlords ultimately becomes a mechanism that is almost impossible to access.
Limited coverage and an operating framework that is still uncertain.
Although it is announced that the guarantee will cover non-payments, damages, and unpaid utilities, the following aspects have yet to be specified:
- The total budget of the program
- The actual resolution timeframes
- The operational procedure
- The speed of compensation
The exact criteria that the autonomous communities will introduce are also still unknown, which adds even more uncertainty for property owners, who need predictability and clarity, not more bureaucracy.
